This Package Tour Sales Agreement (“Agreement”) has been prepared within the scope of the provisions of the Consumer Protection Law No. 6502 and the Package Tour Contracts Regulation, and the relevant legislative provisions will apply to matters not included in the contract. A preliminary information brochure was given to the participant before the Agreement was drawn up, and after the participant read this brochure, this Agreement was drawn up and signed. With this agreement, the participant is Mihrimah sultan Turizm Ltd.Şti. It is aimed to determine the rights and obligations of the parties regarding the sale and performance of the service purchased by (“Hafsatur”), whose qualifications, sales price are stated and whose information is included in the brochure.

  1. TOUR PRICE and PAYMENT METHOD

3.1. The tour price is the figure on the sales screen, including taxes.

3.2. The type and type, duration and sales price of the product/service purchased by the participant are as stated in this Package Tour Preliminary Information Brochure. The prices listed in this Package Tour Preliminary Information Brochure and announced on the Hafsa Tur website are the sales price including all taxes. The prices and commitments announced on the Hafsa Tur website are valid until updated or changed. Prices and commitments announced on a temporary basis are valid until the end of the specified period.

3.3. Hafsa Tur does not make sales in installments. However, for purchases made with bank credit cards, installments are provided to the participant at the discretion of the relevant bank, and Hafsa Tur is not responsible for this installment and related transactions.

  1. SUBJECT

4.1. In line with the provisions of this Agreement, the Law on Consumer Protection No. 6502 and the regulations of the Package Tour Contracts Regulation dated 14.01.2015, natural and legal person consumers acting for commercial and non-professional purposes and on whose behalf or in favor of a package tour has been purchased or promised to be purchased or a package tour has been made to them. The package tour contract is valid for the transferred participant.

4.2. Before signing this Agreement, the participant was informed in writing about the following issues:

  1. The start and end date and location of the journey,
  2. The type of transportation vehicles used and the class of the journey, departure and return dates, times and places,
  3. The type of accommodation, location, qualifications, class, and, if this classification is different from the one applied in Turkey, a warning regarding this difference, including the dates of accommodation,
  4. meal plan,
  5. The route to be followed during the journey,
  6. Information regarding passport, visa, age and health conditions in accordance with the characteristics of the package tour,
  7. If a minimum number of participants is foreseen for the organization of the package tour, this number and if this number is not reached, the last date on which the participant will be notified of the cancellation of the package tour,
  8. Information regarding compulsory insurance in accordance with the Travel Agencies and Association of Travel Agents Law No. 1618 and other insurances, if any,
  9. Information about tourist guide services,
  10. Date and place of intermediate accommodation and transfer information.
  11. The name, address and contact information of the representative of the package tour organizer or its agent at the tour site, or the local contact points that can be contacted if there is no representative, and in the absence of a local representative and contact point, information that will enable the participant to contact the package tour organizer or his agent as soon as possible.
  12. Information regarding storage of information,
  13. Information on identifying and correcting errors in data entries,
  14. Information regarding passport, visa, age and health conditions,
  15. In case of minors traveling abroad or staying abroad, information that will provide direct contact with the participant or the place where the participant stays.

4.3. If the information specified in this article in the preliminary information brochure given to the participant or in the Contract has not changed, no further information will be provided before the trip.

4.4. All information regarding the content of the package tour, including the matters written above, (start and end date and place of the journey, means of transportation used, departure and return time dates and places, accommodation type and qualifications, meal plan, itinerary, visa suitable for the package tour. passport, age and health information, minimum number of participants for organizing the tour and deadline for cancellation notification) Name or title of the tour program and organizer included in the contract, MERSİS number, address, basic features of the ordered products/services, taxes of the products/services Including price, payment and delivery information, fax number or e-mail information, and information that participants can make their applications to the Consumer Court or Consumer Arbitration Committee regarding the dispute are included in the preliminary information brochure delivered with the Agreement.

4.5. By accepting this Agreement, the Participant confirms that he/she has received the preliminary information brochure before the conclusion of this Agreement. The Participant acknowledges that he is a party to this Agreement on behalf of the other participants and that he represents and binds them, and that he is obliged and responsible to inform the participants about the contents of the preliminary information brochure issued to him within the scope of the relevant legal legislation. The participant who does not fulfill her obligation to provide information is responsible for this. Accordingly, the preliminary information brochure containing the tour program given to the participant is deemed to have been given to all participants.

4.6. If there is a change in all this information, Hafsa Tur will inform the participant 24 hours before the start of the trip for Domestic Tours and 48 hours for International Tours.

4.7. If there is a change in all this information, the Participant is responsible for providing the information of himself and the other participants on whose behalf he acts correctly and recording it in the contract. Hafsa Tur informs the participant 24 hours before the start of the trip for Domestic Tours and 48 hours for International Tours. Hafsa Tur is not responsible for the consequences that may occur due to incorrect notification of identity and contact information (for example, airline fines, visa problems, not receiving the necessary information about the travel, not being able to participate in the tour, etc.).

4.8. The Participant acknowledges, declares and undertakes that she and other participants can be reached through the contact information specified in this Agreement.

  1. SECURITY

The information provided by the Participant to Hafsa Tur for the purpose of payment with the information specified in this Agreement is transferred by Hafsa Tur to 3rd party. It will not be shared with individuals. Hafsa Tur will be able to disclose this information only within the framework of the administrative/legal obligation. Participant’s credit card information is never stored; credit card information is only used to obtain authorization by being transmitted securely to the relevant banks during the collection process and is deleted from the system after provisioning.

  1. GENERAL PROVISIONS

6.1. Payments:

6.1.1. The full tour fee is paid at the time of registration. If the tour price is not paid in full, no reservation will be made. However, if a reservation is made despite having an incomplete balance for any reason, the participant is responsible for the entire price of the package tour starting from the date of registration. If the Participant requests cancellation of the Agreement, the cancellation conditions in this agreement will apply. Hafsa Tur does not have installment sales, sales are in cash. The installments mentioned in the promotions are not made by Hafsa Tur, but are installments made by the relevant bank within the scope of the contract between them if the participant pays the fee with a bank card.

6.1.2. For package tours, tour prices are determined in Turkish Lira, including VAT and all other taxes. Although the sales price for international tours is determined in foreign currency, the exchange rate is determined based on the free market rate on the day the contract is drawn up and the payment is made.

6.2. Price Changes:

The price in the Contract; not to exceed five percent of the Contract price, provided that the reason for the price change and how it will be calculated is notified to the participant in writing or via a permanent data recorder at least 20 days before the departure date stipulated in the Contract; In package tours abroad where the contract price is determined in foreign currency, the price change is due to unusual changes in the exchange rate, in all package tours the price change is due to unusual changes in fuel expenses, and the price change is due to taxes, duties, fees and similar legal obligations collected in places such as ports and airports. It can be changed in case of changes.

6.3. Change in Essential Elements of the Agreement:

Before the start of the package tour, Hafsa Tur immediately notifies the participant of any material changes made to the content of the Contract for reasons not caused by the participant and their effects on the price. If one of the essential elements of the Agreement changes, the participant may accept this change, provided that he notifies the package tour organizer or his agent in writing or via a permanent data recorder that he does not accept the change; He/she may exercise one of the optional rights to participate in another package tour of equal or higher value offered by the package tour organizer or intermediary without paying an additional fee, or to participate in a package tour of lower value provided that the price difference is refunded to him/her, or to withdraw from the contract without paying any compensation.

In case of withdrawal from the contract due to these reasons, Hafsa Tur will refund the entire fee paid by the participant, without any deduction, within fourteen days at the latest, from the date on which the notice of withdrawal from the contract is received.

6.4. Cancellation of Package Tour:

If Hafsa Tur cancels the tour before the start of the package tour due to a reason not caused by the participant, the participant, 7.3. may exercise the optional rights specified in the article.

6.5. Incomplete Performance of the Contract:

6.5.1. The Participant must immediately notify Hafsa Tur of any deficiencies that arise during the execution of the Agreement. If this deficiency is not corrected, the participant has the right to request a discount from the Contract price. If it is determined that Hafsa Tur has not fulfilled or cannot fulfill an important obligation after the package tour has started, Hafsa Tur offers equivalent alternative arrangements that do not cause additional costs to the participant for the continuation of the package tour and compensates the difference between the services offered and the services provided to the participant. The Participant may withdraw from the Agreement by not accepting the alternative arrangement. In case of withdrawal from the contract, Hafsa Tur’s right to demand a fee ends and the payments made will be returned to the participant within 14 days at the latest from the date of withdrawal from the contract. However, Hafsa Tur may request an appropriate compensation from the participant for the actions he/she has performed up to that point, in proportion to the extent to which he/she has benefited from the service.

6.5.2. In case of withdrawal from the contract, the package tour organizer or its agent is obliged to provide free transportation of the participant to the place where the package tour started or to another agreed upon place and to cover the expenses incurred in case of compulsory accommodation. The participant may also claim appropriate compensation for wasted holiday time. Without prejudice to the provisions of the Law on Travel Agencies and the Association of Travel Agencies regarding compulsory insurance, the package tour organizer or intermediary is responsible for any damage suffered by the participant due to the non-fulfillment or non-fulfillment of the Agreement.

6.6. Release of Liability:

The package tour organizer or its agent may be liable if the violation of the Agreement is due to the fault of the participant, if there is an unexpected and unpreventable behavior of a third party who is not involved in the execution of the contract, if there is a force majeure, if the package tour organizer or its agent or independent service provider cannot foresee and prevent it despite taking all necessary care. In the event that an event occurs, the package tour is canceled due to not being able to provide the minimum participation required for the organization of the package tour, and the cancellation is notified to the participant in writing or via a permanent data recorder at least twenty days before the start of the package tour within the period specified in the contract, cannot be kept. In this case, the package tour organizer or its intermediary and its representatives at that location are obliged to provide assistance quickly if the participant is in a difficult situation.

6.7. Force Majeure:

Natural disasters, fire, government activities, states of national mobilization, riots, war or attempts at war, strike, lockout, etc., which do not exist and are not foreseen at the time of signing of this Agreement, develop beyond the control of the parties, and may cause the parties to arise. Situations that make it impossible for one or both of them to partially or completely fulfill their obligations and responsibilities under the Agreement or to fulfill them on time will be considered force majeure.

6.8. Contract Transfer:

6.8.1. If it is not possible for the Participant to continue the package tour, the Participant may transfer the Agreement to a third party who fulfills all conditions valid for the package tour by notifying the package tour organizer or agent in writing or via permanent data storage at least 7 days before the start of the tour. The transferor and the transferee of the contract are jointly responsible for the payment of the remaining amount towards the package tour organizer or her car and all additional expenses arising from the transfer in question. However, these costs must be reasonable and in any case must not exceed the actual cost incurred by the package tour organizer or its agent.

6.8.2. Visa fees of participants whose visa process has been completed regarding transferred tours abroad are not refunded. Participants who take over the package tour will be responsible for their visas. Hafsa Tur does not have any responsibility if they do not have a visa or if a visa is not granted until the tour start date even though they have applied. It collects the entire tour fee from the transferor and/or transferee. In package tours, contract transfer can be made according to the changing conditions of the airline companies or hotels.

6.9. Termination of Contract:

6.9.1. The Participant may terminate the Agreement unilaterally, provided that the termination request is notified to Hafsa Tur or its agent in writing or via permanent data storage.

6.9.2. In the case of termination notifications made at least 30 days before the start of the package tour, the amount paid by the participant will be refunded to him/her without any deduction, excluding the costs arising from compulsory taxes, duties and similar legal obligations.

6.9.3. For cancellation requests made 30-20 days before the start of the tour, 50% of the tour price will be refunded.

6.9.4. Cancellation requests less than 20 days before the start of the tour will not be accepted; in this case, the participant agrees to pay the entire tour fee to Hafsa Tur as cancellation compensation.

6.9.5. In case the participant notifies of termination less than thirty days before the start of the package tour due to a situation that the participant cannot foresee and prevent despite taking all necessary care or due to force majeure, expenses arising from obligatory taxes, duties and similar legal obligations, as well as non-refundable expenses that can be paid and documented to third parties and cannot be refunded. The amount paid by the participant will be refunded to him/her without any deduction, excluding the fees.

6.9.6. Refunds are made to the participant within 14 days from the date of termination notification to the package tour organizer or agent.

6.10. Non-Liability Record:

In the contract text or in any separate document, the participant waives the use of his/her rights in the Package Tour Contracts Regulation (“Regulation”) published in the Official Gazette No. 29236 dated January 14, 2011, or limits the obligations of the package tour organizer or its agent arising from the Regulation. or eliminates records are invalid.

  1. IMPORTANT INFORMATION ABOUT PACKAGE TOUR

7.1. In package tour programs, all services included in the price are stated separately. Tours or services other than these are subject to extra fees. For international tours, extra tour fees and contents are determined and recommended by local agencies in the cities and countries visited. These tours can only be done if sufficient participation is ensured, and no compensation and/or refund can be requested from Hafsa Tur due to non-compliance with extra tours. Participants who do not want to participate in the extra tour are kept in places deemed appropriate by the guide on the route. They continue the tour by taking an extra round. Participants participated in the tour knowing and accepting this. The content of extra tours varies depending on the number of participants, such as the vehicle and tour boat to be used. In addition, the days and hours of the tours can be changed by the guide depending on the open/closed status of the museums and ruins in the places to be visited and the weather conditions. Extra tours are optional and not mandatory. Extra tours are provided by the local supplier and the fee is collected by the guide during the tour to be given to the local agency. Therefore, the invoice must be requested from the guide during payment.

7.2. By law, it is mandatory to present an identity card at all accommodation places. Participants who do not present their identity card at the accommodation will not be admitted to the accommodation. In this case, Hafsa Tur is not responsible for the Participants who are not taken to the accommodation. During the Cyprus tours, T.R. It is mandatory and sufficient to have an identity card. Since there are problems in entering Greece later if you enter with a passport, T.R. It is recommended to enter with your identity card.

7.3. It is the number of overnight stays valid for package tours. The first night of accommodation in the package tour is counted as the first day and the first night. Hafsa Tur is not responsible if the Participants cannot benefit from daylight due to delays in transportation vehicles due to force majeure or delays caused by the airline company or time changes.

7.4. The participant who made the reservation and signed the Agreement is jointly and severally responsible for the entire Contract price with the participants on whose behalf he/she made the reservation. If the participants for whom the reservation was made make a cancellation after signing the Agreement without complying with the cancellation periods specified in this Agreement, the participant who signed the Agreement is obliged to pay Hafsa Tur the entire tour fee of the participants on whose behalf the reservation was made.

7.5. Participants cannot be assigned a specific place or seat on the journey.

7.6. Times may change prior to flight and all times must be confirmed 48 hours prior to departure dates. There may be changes in the routes depending on the city where the plane will land.

7.7. You can find out our flight times from our offices. Hafsa Tur cannot be held responsible for time changes and possible delays that may be made by airline companies. Hafsa Tur, in case of compelling reasons; reserves the right to change the tour route provided that its content remains the same. City introduction tours can be held the next day, depending on the arrival time in the city.

7.8. The trips specified in the programs can be done on a day other than the specified day(s) in case of compelling reasons. Lunch and dinner services specified in the program may be provided at restaurants determined by the agency when deemed necessary or due to changes in flight hours.

7.9. Panoramic city tours are 2-3 hour tours organized to introduce cities. City tours and extra tours can be organized on different days, provided that the content does not change. Extra tour prices may vary depending on content and number of participants.

7.10. Personal belongings, bags and suitcases of the people participating in the tour are their own responsibility, and Hafsa Tur is not responsible for forgotten/lost/stolen items. In cases where forgotten items are found, the expenses incurred during delivery to the country and/or person belong to the owner of the item.

7.11. Hafsa Tur reserves the right to change hotel names, provided that the category remains the same. There is an extra bed in rooms for 3 people, and the 3rd bed is smaller than the standard bed. Children’s yachts mentioned in the price list are only valid if the child stays with two adults.

7.12. The continental breakfast offered in hotels consists of butter, jam or honey, bread, tea or coffee and fruit juice. Group breakfasts can be served in a separate lounge.

7.13. People participating in the tour are required to have their Travel Insurance with them during the trip.

7.14. Tours can be combined with other agency tours. In such cases, Hafsa Tur guests are the responsibility of Hafsa Tur.

7.15. 10- In cases where minors under the age of 18 do not participate in the tour with one or both of their parents, the consent forms required for participation in the tour must be kept with them during the travel.

7.16. People are required to bring with them reports regarding their health problems, pregnancy status, and medications they use constantly while participating in the tour.

7.17. Guides may change the program flow depending on weather and road conditions, provided that they show every place specified in the program.

7.18. In cases where only category information is given without specifying the name in the tour program and/or there are options for the same destination, the hotel(s) will be notified by Hafsa Tur 2 days before the trip departure.

7.19. Fair, congress, concert, event, sports tournament, etc. During such periods, hotels can be used at distances greater than the specified km. In such a case, information will be given 15 days before the departure date of the tour.

7.20. Rooms for 3 people can be provided depending on the availability of the hotels, and in these types of rooms 3. The bed assigned to the person is smaller than standard beds. Triple rooms consist of 1 large bed + 1 extra bed. Extra beds. Tour participant 3 as they consist of beds called open-close and couch beds. When making reservations for individuals and/or children, they are deemed to have declared that they accept the congestion and bed type that may occur in the rooms. Child discounts are valid for only one child – matching the age group – staying with 2 adults. Panoramic city tours included in the tour package are tours of maximum 2-3 hours, organized for the general introduction of the cities and panoramic with narration from the in-car guide, and do not include entrances to museums and ruins.

7.21. Panoramic tours, including other tours specified in the program, are not allowed to be visited or entered by local authorities on the day and time of the tour, or in cases where the tour is not allowed due to closed roads due to any event, or when the tour becomes impossible due to weather conditions. Hafsa Tur is not responsible for tours not being held. Some tours can be done by public transport or on foot, if possible, on closed roads or at points where vehicle entry is not allowed.

7.22. Extra tours cannot be made if sufficient numbers are not provided, or extra tour prices, content, and the vehicle to be used vary depending on the number of participants. In addition, the days and hours of the tours can be changed by the guide depending on the open/closed status of the museums and ruins in the places to be visited and the weather conditions.

  1. INFORMATION ABOUT PLANE TRANSPORTATION

8.1. Check-in (i.e. pre-flight registration) must be done by the participant. When the participants arrive at the airport, they must go to the relevant airline counter or, if the relevant airline company allows, up to 2 hours before the flight, they can personally check-in online from the website, obtain their boarding cards indicating their departure gates, times and seat locations, and carry out their baggage procedures. is required.

8.2. The participant who does not check in on time and receive the boarding pass will bear all the losses if she cannot board the plane or participate in the tour. The entire tour fee will be collected from him/her. Participants must be present at the airport with a valid passport at least 3 hours in advance for international flights and at least 2 hours in advance for domestic flights, and their identity card for domestic and Cyprus flights.

8.3. For minor children who are not traveling with their parents, have only one parent with them, and/or do not have the same surname as their parents, it is mandatory to have a notarized consent form given by their official guardian/parent. Children under the age of 2 are required to travel in their mother’s arms. Seats cannot be sold. Every adult has the right to travel with only one baby. Children over the age of 2 are required to have a seat, and traveling on laps is prohibited. The participant is responsible for incorrect birth dates given during the tour reservation. If this situation is noticed during check-in, the sanctions and rules of the relevant airline apply. Hafsa Tur does not have any liability.

8.4. Since the regulations regarding charter flights (that is, flights purchased without a schedule) are subject to international aviation rules, airlines have the right to change any time changes, aircraft type, and airline company on these flights. Departure time cannot be guaranteed, the carrier may change the stopping places shown on the tickets or make stops. The hours specified during the sale are possible hours and Hafsa Tur cannot be held responsible for any changes. For this reason, cancellation and refund requests cannot be accepted. In case of cancellation of flight tickets purchased for charter flights, a refund can be made in accordance with the conditions applied by the airline company by contacting the relevant airline company due to the nature of the flight ticket. It is not possible for Hafsa Tur to make any other applications.

8.5. For matters not written in this Agreement, the provisions of the relevant legislation in force regarding aircraft transportation, IATA, IHA, UFTAA Convention provisions, Civil Aviation Law, international agreements to which Turkey is a party and the statutes, regulations, circulars and communiqués issued accordingly shall apply.

8.6. Hafsa Tur acts as an intermediary between the airline and the participants and is subject to the Hague Protocol dated 28.09.1955. Participants accept and undertake that they have purchased the tours knowing and accepting the risk of time change. Hafsa Tur, which has the status of a brokerage firm, is obliged to notify the participant as soon as it receives notice of such a change. In order to avoid any mishaps, it is recommended that the participant call Hafsa Tur at least 48 hours before the flight and confirm the flight time.

8.7. In plane transportation, in case of loss or damage to luggage, the rules of the relevant airline company apply and it is clearly accepted by the participant that Hafsa Tur is not responsible.

8.8. Cancellation and change requests for package tour or individual scheduled flights can be made according to the ticket class rules determined by the airline. Since Hafsa Tur cannot do anything other than this, the participant’s requests other than this cannot be fulfilled.

8.9. For pregnant participants between 28-35 weeks (inclusive), a doctor’s report issued at least 7 days before the flight is required, stating “there is no harm in traveling by plane”. 35. After 2 weeks, pregnant participants are not allowed to fly even if they have a doctor’s report. For participants expecting twins, this period is 28-32 (inclusive) weeks.

8.10. Pets are not allowed on the plane (visually impaired participants can travel in the cabin with their trained and certified dogs).

8.11. The participant must contact the airline and request any special transportation services to be requested at the airport.

8.12. Since last-minute flight delays and gate changes are determined by the airline at the airport, they are announced to the participants through information boards or announcements in the area. Such notifications are made instantly, and since it is not possible for Hafsa Tur to have prior knowledge, it is the passenger’s responsibility to be careful about and follow these warnings in the area.

8.13. In general terms of airlines, baggage allowance is limited to 15 kg. Hand luggage taken into the cabin is limited to 8 kg. According to international rules, liquids, gels and aerosols in containers of up to 100ml each can be carried in hand luggage on all flights, in a 1-liter sealed vacuum-sealed bag. Each passenger can carry only 1 bag.

8.14. The classes of flight tickets defined by the airline are included in the flight details on the flight voucher. Each nation is subject to the cancellation and refund conditions determined by the airline of its class. Cancellations, refunds and changes cannot be accepted for promotion class tickets. In other classes, cancellation and change transactions and fee deductions resulting from these transactions are determined by the airline within the scope of the rules determined by the airline. The participant can obtain all this information by contacting the relevant airline.

8.15. Hafsa Tur cannot be held responsible for the flights the participant misses due to personal reasons, or the participant’s inability to fly due to lack of personal documents, errors or legal problems. The full tour fee is charged.

8.16. No cancellation/change or compensation claims for loss of time are accepted for the hotel reservation purchased by the participant along with the flight ticket due to the flight not being able to be realized for any reason and/or the flight being postponed or landing at a different airport due to force majeure. If the flight does not take place due to overbooking from the airlines, Hafsa Tur does not have any responsibility and acts in accordance with the airline’s rules and practices. In order to prevent overbooking problems that may occur at the airport on scheduled flights, participants are recommended to check in online.

9.2. Routes: They are determined by considering the shortest time and distance between the departure point and the destination point, depending on the weather and road conditions. Hafsa Tur may make changes to the itinerary as per the conditions. Travel times may vary depending on weather, road and traffic conditions.

9.3. Hafsa Tur bus transportation starts at the departure points specified during the sale. Participants choose the most suitable point from the specified departure points during the sale and must be at the chosen point 15 minutes before the specified date and departure time.

9.4. Hafsa Tour buses depart from the specified departure points in the specified order and time. The participant accepted the time between the two departure points.

9.5. No seat number guarantee can be given to any participant for Hafsa Tur bus transportation. Special situation information or front seat requests from the sales representative are taken into consideration based on availability, and implementation cannot be guaranteed.

9.6. Since there is not enough participation in cases where the sale is below 35 seats, Hafsa Tur may transfer its bus service purchasing participants to bus companies known in the sector that carry out intercity passenger transportation and have the documents required by law. In this process, the boarding point and departure times promised to the participant lose their validity and change to the nearest boarding point and nearest departure time of the transferred bus company. Information regarding the transfer process will be notified to the participants at least 1 day before the bus departure. Participants can use the free city bus services of the bus companies by contacting the company.

9.7. During the journey, participants are obliged to comply with the rules such as acting in accordance with the Highway Transportation Law and other relevant legislation, wearing seat belts, not traveling standing, and ensuring the safe travel of their children. Penalties arising from this are collected from the relevant participant.

9.8. All warnings from the vehicle driver and assistant personnel must be taken into account by the participants during the journey.

9.9. During the trip, breaks are taken at designated places at reasonable intervals. Other special break or pause requests will not be accepted.

9.10. There are certain destinations for trips made with both Hafsa Tur buses and ticketed company buses. Depending on the region or hotel where the participants will stay, all participants are transported to their hotels within a certain route, respectively, via transfer vehicles from these points. Participants are deemed to have accepted the intermediate transfer service and conditions that will be provided with a different vehicle to reach their hotel along with the bus transportation they receive.

9.11. For return transportation, participants are picked up from their hotels on the same day and along with other participants who will travel by vehicle, according to a suitable route, and start their journey, according to the hours notified by the regional authorities the day before. Time information is determined according to the route and time to be followed between hotels, taking into account the number of participants and the hotels they stay in.

9.12. Participants can be picked up directly from their hotels by bus, or under suitable conditions, they can also be picked up by an intermediate transfer vehicle and transported to the bus departure point.

9.13. According to the rules, it is not possible to drop off passengers at any point other than the designated landing points on return trips.

9.14. Hafsa Tur’s responsibility for the journey ends at the specified destination. For participants who are ticketed with a different company, the destinations determined by the company are valid.

9.15. Hafsa Tur cannot be held responsible for personal luggage or belongings forgotten or lost on the buses. Participants must insure their luggage carrying valuable items with a private insurance company.

9.16. Participants must comply with the precautions taken by the carrier in terms of security. Participants cannot engage in attitudes or behaviors that would endanger the navigation and safety of traffic, disturb other participants, or violate general morality and good manners. No electronic device can be used that will affect the technical equipment of the vehicle.

9.17. Depending on the number of people, transportation services can be provided by midibuses or minibuses, in accordance with tourism transportation rules, instead of buses for intermediate bus transportation in airplane cultural tours or international tours.

9.18. In order to ensure the continuity of the package tour in domestic cultural tours or international cultural tours by road, transportation services can be provided by midibuses or minibuses, depending on the number of people and in accordance with tourism transportation and travel conditions. The participant is informed about these changes in the means of transportation before the trip.

  1. TRANSFER TRANSPORTATION INFORMATION

Vehicle Types: Passenger Car – Minibus – Midibus – Bus

10.1. Transfer services include transportation between the participant’s destination airport and the hotel they booked, or from their hotel to the airport in the region.

10.2. Economic transfers are transfer services where the vehicle type is determined depending on the number of people and used by more than one passenger.

10.3. In the area where transfer service will be provided, participants are welcomed with a Hafsa Tur sign or stand, but the participant’s name is not greeted.

10.4. Private transfer service is a transfer service provided to participants who make a reservation where the vehicle type is determined depending on the number of people, and is private and not combined with different reservations or persons.

10.5. Economical transfer times are arranged according to flight schedules, taking into account the upcoming arrival times of different airlines. Therefore, the participant is deemed to have accepted the possibility of waiting for other participants for up to 1 hour from the landing time.

10.6. In the economic transfer process with more than one participant, the participants who will be settled in different hotels starting from the departure from the area are delivered to their hotels one by one according to the appropriate route.

10.7. Participants who missed the economic transfer time due to the delay in their flight must wait for the next economic transfer time.

10.8. The maximum waiting time for participants receiving private transfer service is 2 hours. For delays of more than 2 hours, the transfer service is deemed canceled and cannot be refunded.

10.9. Cancellations/refunds or changes can be made for transfer service requests up to 48 hours in advance.

10.10. Transfer services of participants who cannot make a last-minute flight or who do not notify the flight cancellation within the valid period cannot be canceled/refunded, and transfer services cannot be changed if they receive a new transportation with a plane at a different time. Last minute cancellations/refunds or changes cannot be made for transfers from the hotel to the area.

10.11. For the transfer service from the hotel to the area, the exact time information is sent to the participant by Hafsa Tur regional authorities one day before the transfer day.

10.12. In economical transfers from the hotel to the area, the pick-up times of the participants from their hotels are determined by taking into account the routes of the other participants in the different hotels where they will receive service, the time zone to be in the area before the flight in accordance with the airline conditions, and the road conditions.

10.13. During their travels in transfer vehicles, participants are obliged to comply with the rules such as wearing seat belts, not traveling standing, and ensuring the safe travel of their children in accordance with the highway transportation law.

10.14. Hafsa Tur cannot be held responsible for personal luggage or belongings forgotten or lost in the transfer vehicle.

  1. INFORMATION REGARDING PAYMENTS MADE BY DEBIT CARD

11.1. Sözleşmeye taraf Hafsa Tur hiçbir şekilde kendi bünyesinde taksitli satış yapmamaktadır.

11.2. The prices given to the participants are cash prices, and all installments are made by Hafsa Tur without any interest on the credit cards obtained from various banks upon the participants’ request. All transactions regarding sales made by credit card are carried out between the participant who owns the card and the bank to which the card is linked, and Hafsa Tur has no right or responsibility to intervene in these transactions.

11.3. Participants who purchase services with a credit card can benefit from early payment, installment reduction, etc. They must notify their requests to the bank to which the card belongs and make them to the payment branches determined by the bank.

11.4. When Participants cancel the service they received in installments by credit card for any reason, if the cancellation conditions are accepted by Hafsa Tur and the right to a refund arises, Hafsa Tur will refund the amount received from the credit card to the Participant’s credit card. Hafsa Tur’s liability is limited to this. All subsequent transactions are carried out between the bank and the participant, Hafsa Tur has no right or responsibility to intervene in the payment or payment method. Bank rules also apply to refunds for payments made in installments, and Hafsa Tur has no liability or possibility of intervention if payments made in installments are returned to the card in installments.

11.5. For purchases made by credit card, the relevant bank’s current campaign and the associated cancellation and refund conditions are valid.

  1. INFORMATION ABOUT MANDATORY TRAVEL INSURANCE

According to the Travel Agencies and Association of Travel Agents Law No. 1618, compulsory package tour liability insurance policies of the participants who purchase package tours are taken out by the agency to the insurance company. Compulsory travel insurance is a protective insurance against agency bankruptcy and defective service, and does not cover travel health and assistance services.

  1. AUTHORIZED COURT

All Consumer Courts of the Republic of Turkey, Consumer Arbitration Committees and other organizations authorized by law are authorized to resolve all disputes arising from this agreement. Participants may submit their complaints and objections to the Arbitration Committee for Consumer Problems or the Consumer Court in the place where the Participant purchased the goods or services or where he/she resides, within the monetary limits determined by the Ministry in December every year.

Additional Article 1 – Hafsa Tur is not responsible for whether the accommodation facility complies with the measures that must be taken in the accommodation facilities, announced by the relevant ministries, governorships, provincial directorates and other administrative units, but not limited to them, due to the COVID-19 epidemic. In addition, in order to ensure compliance with the measures to be taken by the relevant ministries, governorships, provincial directorates and other administrative units, but not limited to them, in the accommodation facilities due to the COVID-19 epidemic, the facility to be accommodated will inform the Customer about the scope, subject and other service-related issues of the service that the Customer expects to be provided to him. Hafsa Tur cannot be held responsible for changes made without prior notice. Making such changes by the accommodation facility will not mean that Hafsa Tur has not fulfilled its obligations under this customer agreement at all or properly, or will not be considered a service defect. In addition, in order to ensure compliance with the aforementioned measures, requests may be made due to the accommodation facility making changes to the scope, subject and other service-related issues that the Customer expects to be provided to him/her under this customer agreement, without prior notice to the Customer, or due to the accommodation facility not complying with the above-mentioned measures. It may be directed to the facility and does not give the Customer the right to terminate this customer agreement, withdraw from the agreement or cancel the reservation.

I have read and approved this Agreement, on behalf of myself and the participants whose names are written below, in its final version. A copy has been delivered to me along with all its annexes (preliminary information brochure and voucher along with this Agreement) – if purchased – the relevant insurance policy and specifications in writing / via a permanent data recorder. Within the scope of the Consumer Protection Law and the Package Tour Contracts Regulation, within the scope of the package tour I purchased, which is the subject of this Agreement, I have read and learned all the services offered and their qualities, the sales price and payment method and all preliminary information regarding the performance, and by reading the content and articles of this Agreement. I acknowledge and declare that I understand and have been informed. This declaration is also valid if my reservation transactions are carried out and signed by someone else on my behalf.

*During the travel to be made within the scope of this Agreement, additional amounts such as city tax, accommodation tax, which are foreseen in the legislation or may be foreseen in the future to be paid by the traveler, are not included in the price of the purchased Hafsa Tur product, which is the subject of this Agreement, stated in this Agreement and may be requested. In such cases, it will be paid separately by the traveler.
